§ 1 INFORMATION ABOUT THE COLLECTION OF PERSONAL DATA

(1) In the following, we provide information about the collection of personal data when using our website and services. Personal data is any data that relates to you personally, such as name, address, e-mail addresses, user behavior.

§ 2 COLLECTION OF PERSONAL DATA WHEN YOU VISIT OUR WEBSITE

(1) For merely informational use of the website and therefore if you are not registering or otherwise providing us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data that is technically necessary for us in order to display our website to you and ensure stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f GDPR):

(4) Use of Google Analytics:

a) This website uses Google Analytics, a web analysis service provided by Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files that are stored on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymization is activated on this website, Google will abbreviate your IP address beforehand within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and abbreviated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and Internet usage to the website operator.

b) The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google.

d) This website uses Google Analytics with the “_anonymizeIp ()” extension. As a result, IP addresses are further processed in abbreviated form, so that identification of a person can be ruled out. e) We use Google Analytics to analyse and regularly improve the use of our website. Using the statistics obtained, we can improve our offer and make it more interesting for you as a user. For exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework. g) This website also uses Google Analytics for cross-device analysis of visitor flows, which is carried out via a user ID. You can deactivate the cross-device analysis of your usage in your customer account under “My data”, “personal data”.


(5) Integration of Google Maps:


a) On this website, we use the services offered by Google Maps. This allows us to display interactive maps directly on the website and enables you to conveniently use the map function.

b) When you visit the website, Google receives the information that you have accessed the corresponding subpage of our website. In addition, the data specified under § 3 of this declaration will be transmitted. This is done regardless of whether Google provides a user account through which you are logged in, or whether there is no user account. If you are logged in to Google, your data is directly associated with your account. If you do not want to be associated with your profile on Google, you must log out before activating the button. § 3 COLLECTION OF PERSONAL DATA WHEN USING OUR SERVICES (INCLUDING FARU-BUSINESSCOCKPIT, FARU-INVENTORYMANAGER, FARU-CATEGORYANALYSIS AND FARU-ASINCRAWLER)

(1) If you want to use our services, it is necessary for the conclusion of the contract that you provide your personal data, which we need to process the contract and to provide our service. Mandatory information required to process contracts is marked separately; further information is voluntary.

(2) Depending on the service, access to your Amazon account may be required to provide the contractual service. In addition, depending on the service, the following data is collected: Item information that is not delivered via Amazon, e.g. EC, purchasing region, item dimensions/ weight, manufacturer information, information about Amazon advertising campaigns, seller ID, order ID and statistical information, such as time of orders, turnover and ordered items, item number, description and prices.

(3) In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly checked.

(4) Insofar as our service providers or partners are based in a state outside the European Economic Area (EEA), we will inform you of the consequences of this fact in the description of the offer.

(5) To prevent unauthorised access by third parties to your personal data, in particular financial data, the ordering process is encrypted using TLS technology.

§ 4 NEWSLETTER

(1) With your consent, you can subscribe to our newsletter, which we use to inform you about our current interesting offers. The advertised goods and services are specified in the declaration of consent.

(2) We use the so-called double opt-in procedure to subscribe to our newsletter. This means that after you have signed up, we will send you an email to the specified email address asking you to confirm that you wish to receive the newsletter. If you do not confirm your subscription within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we save the IP addresses you use and the time of registration and confirmation. The purpose of the procedure is to be able to prove your registration and, if necessary, to clarify any possible misuse of your personal data.

(3) The only mandatory information for sending the newsletter is your e-mail address. The provision of further, separately marked data is voluntary and is used to be able to address you personally. After your confirmation, we save your email address for the purpose of sending you the newsletter. The legal basis is Art. 6 (1) (a) GDPR.

(4) You can withdraw your consent to receive the newsletter at any time and unsubscribe from the newsletter. You can declare your withdrawal by clicking on the link provided in every newsletter e-mail or by sending a message to the contact details provided in the legal notice.

§ 5 LEGAL BASIS FOR PROCESSING PERSONAL DATA

(1) Insofar as we obtain consent from the data subject for processing personal data, Article 6 (1) (a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.

(2) When processing personal data that is necessary to fulfill a contract to which the data subject is a party, Article 6 (1) (b) GDPR serves as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures.

(3) Insofar as processing of personal data is necessary to fulfill a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis.

(4) If processing is necessary to protect a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Article 6 (1) (f) GDPR serves as the legal basis for processing.

§ 6 DATA DELETION AND STORAGE PERIOD

The personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Storage may also take place if this has been provided for by European or national legislators in EU regulations, laws or other regulations to which the person responsible is subject. Due to commercial and tax regulations, we are required to store your address, payment and order data for a period of ten years. The data will also be blocked or deleted when a storage period prescribed by the above standards expires, unless there is a need to continue storing the data for the conclusion or performance of a contract.

§ 7 YOUR RIGHTS

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the person responsible:

(1) Right to information
You can request confirmation from the person responsible as to whether personal data concerning you is being processed by us.

(2) Right to rectification
You have the right to correct and/or complete the data controller if the processed personal data concerning you is incorrect or incomplete.

(3) Right to restrict processing
You have the right to request that the processing of all or part of your personal data be stopped temporarily or permanently.

(4) Right to deletion
You can request that the person responsible delete the personal data concerning you immediately.

(5) Right to be informed
If you have asserted the right to correct, delete or restrict processing against the person responsible, the controller is obliged to notify all recipients to whom the personal data concerning you has been disclosed of this correction or deletion of the data or restriction of processing, unless this proves impossible or involves disproportionate effort. You have the right vis-à-vis the person responsible to be informed about these recipients.

(6) Right to data portability
You have the right to receive the personal data concerning you, which you have provided to the person responsible, in a structured, commonly used and machine-readable format.

(7) Right of objection
For reasons arising from your particular situation, you have the right to object at any time to the processing of personal data concerning you, which is carried out on the basis of Article 6 (1) (e) or (f) GDPR; this also applies to profiling based on these provisions. If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.

(8) Right to withdraw the declaration of consent under data protection law
You have the right to withdraw your data protection consent at any time. Withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent up to the withdrawal.

(9) Automated decision in individual cases, including profiling
You have the right not to be subject to a decision based exclusively on automated processing — including profiling — which has legal effect on you or significantly affects you in a similar way.

(10) Right to lodge a complaint with a supervisory authority
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you believe that the processing of personal data concerning you is contrary to the GDPR.
